MEC denies police can’t enforce new Liquor act

The Western Cape Economic Development and Finance MEC says police have no problems using the new Liquor Act.

Garth Strachan met with South African Police Service officials on Monday after media reports that they were having trouble implementing provisions of the new Liquor Act to shut down illegal shebeens.

Last week, 40 shebeens which by police were reportedly reopened, because certain sections of the Act had not been legislated.

Strachan told Eyewitness News the act empowered police to shut down shebeens.

“They strongly disputed claims about the 40 shebeens. There are a very small number of instances where they have recommended to the National Prosecuting Authority not to proceed with charges," said Strachan.

 

The MEC said although the full act had not yet been legislated police were not powerless to act against illegal shebeens.

“Well, they can use those clauses that we have already passed. There is a problem with 76d and e but in any case the old liquor act prohibits any person from selling alcohol if they are not in possession of a license.”

Strachan added that reports of police hesitation to use the act had been exaggerated.
