ConCourt: here’s how to attach state assets

The Constitutional Court has explained how people who have successfully sued the state can attach assets if government refuses to pay.

 

The order will stay in force for the next two years or until Parliament passes legislation to deal with the issue.

 

The decision means people owed money by the state can attach removable assets from national or provincial assets for as long as this order is in force.

 

Judge Yvonne Mokgoro announced the unanimous decision, meaning people owed money can approach the national or provincial treasury and only then apply for a court order to take the assets.

 

There is also a 30 day notice period for people to object to the attachment.
