The National Prosecuting Authority (NPA) on Thursday confirmed filing papers with the Supreme Court of Appeal opposing the Minister of State Security’s bid to stop a former spy boss testifying in the Jackie Selebi trial.
However, the NPA maintained it would not make the papers, which were filed on Monday, public.
It said it wanted the dispute to be ventilated through the proper forum.
This sideshow is delaying the matter from continuing and is likely to force another delay when the case returns to court on the first of next February.
The South Gauteng High Court last year refused the minister leave to appeal against a decision forcing ex-intelligence official Barry Gilder to take the stand against the former police chief.
The minister decided to petition the Supreme Court of Appeal.
