State Security Minister Siyabonga Cwele’s lawyers said on Monday they filed papers with the National Prosecuting Authority (NPA) in a bid to stop former intelligence boss Barry Gilder from testifying in the Jackie Selebi trial.
They added he would only file papers with the Constitutional Court on Tuesday morning.
Cwele wants to overturn a decision by the South Gauteng High Court ordering Gilder to testify in camera against the former police chief about a draft report which alleged Selebi was receiving money from the Kebbles.
Last year Judge Meyer Joffe ruled Gilder should testify in camera and only about matters he had personal knowledge about.
