Inmates could have bid to challenge Radebe dismissed

A case against Justice Minister Jeff Radebe, brought by a group of Johannesburg prisoners, could be struck off the roll following a number of postponements.


The inmates launched a lawsuit against the minister for failing to provide them with transcripts of their trial records which have apparently gone missing. This means they have not been able to apply for leave to appeal.


The matter was postponed in the South Gauteng High Court on Tuesday and will be heard on Wednesday.


The registrar of the South Gauteng High Court, the Provincial Director of Public Prosecutions and Legal Aid South Africa are all respondents in the matter.


The Justice Ministry’s Tlali Tlali said it has emerged that two of the respondents were not properly served.


“The court has decided that the matter to roll over to hear argument to hear whether we proceed on the basis of what we have or if whether there is basis from Legal Aid SA or the Director of Public Prosecutions that they were not properly served with papers,” Tlali said.
