Kriegler denies Hlophe plot claim

Former Constitutional Court judge Johann Kriegler has lodged an affidavit in the Western Cape High Court, saying that certain claims by Western Cape Judge President John Hlophe that the retired justice was part of a campaign against him are untrue.

Lawyers for Western Cape Premier Helen Zille have told the court she should have been represented in the Judicial Service Commission disciplinary committee that absolved Hlophe of wrongdoing.

The Constitutional Court accused Hlophe of trying to interfere in cases relating to President Jacob Zuma.

In his documents Kriegler, representing the NGO Freedom Under Law, says he has never called for Hlophe to be suspended or dismissed, and that he was not involved in Wednesday’s legal bid by Helen Zille.

In that case two judges brought in from other provinces to hear the case, heard that the JSC hearings that cleared Hlophe should be declared null and void.

Lawyers representing Zille say the JSC was not properly constituted at the time, and thus its hearings should be held again.
