Nassif’s indemnity under threat

Clinton Nassif’s indemnity from prosecution was on the line after Friday morning’s proceedings.

 

Brett Kebble’s former security chief took a pummelling on the witness stand as he gave evidence in the mining magnate’s murder trial.

 

He was testifying against Glenn Agliotti who is accused of masterminding the killing and other crimes.

 

Amidst a heated argument, Agliotti’s advocate Laurance Hodes threatened to argue for Nassif’s indemnity from prosecution, as outlined in his section 204 agreement, to be disregarded. He said this was because Nassif was repeatedly lying to try and implicate Agliotti.

 

It was also revealed in court that a statement which Nassif signed earlier this year detailing the Kebble killing, is not protected by the indemnity agreement.

 

When Nassif realised this he told the court he wanted legal advice before carrying on. However the judge refused and Hodes told the witness he was not entitled to speak to his lawyer anyway.

 

The ex-security man was against the ropes all day and welcomed the respite brought by the midday adjournment.
